Acceptance of Terms

These Terms of Service (“Terms”) govern the use of services provided by Powers Installation LLC (“we,” “our,” or “us”). By using our services, scheduling an appointment, or providing a phone number, email address, or other contact information for service coordination, you (“customer” or “you”) agree to be bound by these Terms. If you do not agree, please do not use our services or provide your information to us.

Services

Powers Installation LLC provides residential window coverings services in the Kansas City metropolitan area, including on-site measuring; installation of blinds, shades, and shutters; motorization; repairs and repulls; and warranty service in coordination with partner retailers such as 3 Day Blinds.

Scheduling and Communication

Appointments are scheduled by phone with our office or in coordination with partner retailers. Once an appointment is set, service-related communication is conducted through a combination of phone, email, and SMS — with SMS used primarily for time-sensitive updates such as appointment confirmations, scheduling changes, and arrival notifications on the day of service.

Customers are responsible for providing accurate contact information at the time of scheduling and for keeping that information current so that service-related messages reach them.

SMS / Text Message Terms

The terms below govern SMS (text message) communications between Powers Installation LLC and customers who have opted in to receive them. These terms apply in addition to the SMS-related disclosures in our Privacy Policy.

The program

This SMS program is operated as Powers Installation LLC Service Notifications. All messages sent under this program identify Powers Installation LLC as the sender. By opting in, customers will receive SMS messages from us for the following purposes:

• Appointment confirmations
• Installation scheduling updates
• Arrival notifications
• Service reminders
• Customer service follow-ups

This is a transactional service messaging program. We do not send marketing or promotional messages under this program.

Frequency

Message frequency varies based on appointment and service activity.

Cost

Message and data rates may apply per your mobile carrier’s plan.

Opting in

Consent to receive SMS messages is collected verbally at the time of scheduling, when a customer provides their phone number to our office or to 3 Day Blinds for service coordination. Written confirmation of consent is provided at the time of scheduling.

Opting out

To opt out at any time, reply STOP to any message. You will receive a confirmation message and no further messages will be sent unless you opt in again.

Carrier disclaimer

Carriers are not liable for delayed or undelivered messages.

Privacy

Information collected through SMS is handled in accordance with our Privacy Policy. Mobile phone numbers and SMS opt-in data are not shared with third parties or affiliates for marketing or promotional purposes under any circumstances.

Limitation of Liability

To the maximum extent permitted by law, Powers Installation LLC is not liable for indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, or business interruption — arising out of or related to these Terms, our services, or our SMS communications, even if we have been advised of the possibility of such damages.

Our total liability for any claim arising under these Terms is limited to the amount the customer paid to Powers Installation LLC for the specific service giving rise to the claim.

Nothing in this section limits any rights that cannot be waived under applicable consumer protection law. If a court finds any portion of this limitation unenforceable, the remainder will continue to apply to the maximum extent permitted by law.

Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict of laws principles. Any dispute arising out of or related to these Terms will be resolved in the state or federal courts located in Missouri, and both parties consent to personal jurisdiction in those courts.

Changes to Terms

We may update these Terms from time to time. When we do, we will revise the Effective date at the top of this page. Continued use of our services or continued receipt of SMS messages after a change indicates acceptance of the updated Terms.
